1. General Risk
SmartPayFX is designed to simplify payments between users, supported mobile money services, supported trading platforms and selected digital currencies. However, no digital payment system is completely free from risk.
Risks may arise from telecommunications networks, payment providers, banks, trading platforms, blockchain networks, user error, fraud, compliance requirements, technology failures or events outside SmartPayFX's reasonable control.
2. Trading Platform Risk
SmartPayFX may facilitate supported deposits or withdrawals involving trading platforms such as Deriv, Weltrade, HFM and Exness.
Trading financial products can result in losses. SmartPayFX does not control trading positions, account performance, leverage, market movements, broker execution, platform rules or investment decisions made by users.
A successful deposit through SmartPayFX does not mean that a user will earn a profit from trading, and SmartPayFX does not guarantee or insure any trading outcome.
3. No Investment, Trading or Financial Advice
SmartPayFX's services are intended to facilitate supported payments and related transactions. Information displayed through SmartPayFX should not be treated as investment, trading, tax, legal or financial advice.
Users are responsible for deciding whether to trade, invest, buy or sell digital currencies or use any third-party financial platform.
4. Exchange Rate & Rate Lock
SmartPayFX displays the applicable exchange rate to the user before a transaction is initiated.
Once the user confirms and initiates the transaction, the displayed exchange rate is locked for that transaction. The transaction will therefore be completed using the same rate that was shown and accepted at the beginning of the transaction.
Changes in market exchange rates after the transaction has been initiated will not alter the rate already confirmed for that specific transaction.
If a transaction is cancelled, rejected, expires, fails or must be initiated again, the user may be shown a new exchange rate for the new transaction.
5. Processing Delay Risk
SmartPayFX is designed for fast transaction processing. However, transaction completion may occasionally be delayed by circumstances outside SmartPayFX's direct control.
Possible causes may include:
- Mobile network delays or outages.
- Mobile money provider downtime.
- Trading platform maintenance or processing delays.
- Blockchain network congestion.
- Banking or settlement delays.
- Verification or compliance checks.
- Incorrect or incomplete transaction information supplied by a user.
- Unexpected technical failures affecting third-party infrastructure.
SmartPayFX does not guarantee that every transaction will complete within a specific number of seconds where completion depends on external service providers or networks.
6. Third-Party Service Risk
SmartPayFX relies on or interacts with third-party services such as mobile money operators, banks, trading platforms, blockchain networks, telecommunications providers and other payment infrastructure.
These third parties may experience outages, maintenance, restrictions, policy changes, technical failures, transaction reversals, service interruptions or processing delays.
SmartPayFX cannot guarantee the continuous operation, financial condition, security or performance of any independent third party.
7. Mobile Money Risk
Supported mobile money services may include M-Pesa, Airtel Money, Mixx by Yas and Halopesa.
Mobile money transactions may be affected by network availability, wallet limits, account restrictions, provider maintenance, provider fees, SIM-related issues or verification requirements.
Users are responsible for ensuring that the mobile money number and account information provided for a transaction are correct and that they are authorised to use the relevant mobile money account.
8. Digital Currency Risk
SmartPayFX may support buying and selling selected digital currencies such as USDT and Bitcoin (BTC). Digital assets may involve significantly different risks from traditional money or bank deposits.
These risks may include:
- Price volatility.
- Changes in market liquidity.
- Blockchain network congestion.
- Wallet or address errors.
- Cybersecurity and theft risks.
- Protocol or network changes.
- Regulatory changes.
- Losses arising from user-controlled wallets or credentials.
SmartPayFX does not guarantee that USDT, BTC or any other supported digital currency will maintain a particular market value.
9. Blockchain Transactions & Irreversibility
Many blockchain transactions cannot be cancelled or reversed once they have been validly broadcast and confirmed.
If a user provides an incorrect wallet address, chooses an incompatible network or sends assets to an unsupported destination, recovery may be impossible.
Users must carefully verify wallet addresses, networks and transaction details before confirming a digital-currency transaction.
10. Liquidity Risk
The availability of supported digital currencies and certain payment transactions may depend on market and operational liquidity.
During periods of unusual demand, market disruption or limited availability, SmartPayFX may temporarily limit, delay or suspend certain buying, selling or settlement services until adequate liquidity becomes available.
11. User Information & Input Error Risk
Users are responsible for entering correct transaction information, including mobile money numbers, trading account identifiers, wallet addresses, amounts and other required account details.
Transactions sent using incorrect information may be delayed, rejected, credited to the wrong destination or become difficult or impossible to recover.
SmartPayFX may attempt to assist in investigating an error, but recovery cannot be guaranteed where funds have already been processed to information supplied by the user.
12. Compliance, KYC & Verification Risk
SmartPayFX may conduct identity verification, transaction monitoring and other AML/KYC or fraud-prevention checks.
A transaction may therefore be delayed, restricted, rejected or placed under review where additional information is required, suspicious activity is detected, information is inconsistent, or legal and compliance requirements apply.
Users may be required to provide identification, proof of payment, source-of-funds information, account-ownership evidence or other supporting documentation.
13. Cybersecurity Risk
SmartPayFX uses technical and operational safeguards intended to protect its systems and users. However, no online platform, mobile network, blockchain system or digital payment service can guarantee complete protection against every cybersecurity threat.
Risks may include phishing, malware, stolen credentials, SIM-swap fraud, unauthorised device access, social engineering, account takeover or attacks against third-party providers.
Users should protect passwords, verification codes, devices, wallet credentials and account access information and should never knowingly provide such information to unauthorised persons.
14. System Availability & Technology Risk
SmartPayFX aims to provide reliable service, but access may occasionally be interrupted because of planned maintenance, system upgrades, network failures, software defects, infrastructure failures or circumstances beyond reasonable control.
Temporary service interruptions do not necessarily mean that a transaction has failed. Users should check the transaction status or contact SmartPayFX Support before attempting duplicate payments.
15. Fees & Third-Party Charges
Where applicable, SmartPayFX will display or communicate relevant transaction terms before confirmation.
Separate charges may also be imposed by mobile money providers, blockchain networks, banks, trading platforms or other third parties. Such charges may be outside SmartPayFX's control.
Users should review the applicable transaction information before confirming a payment.
16. Fraud, Impersonation & Scam Risk
Criminals may attempt to impersonate SmartPayFX, its employees, mobile money providers or trading platforms.
Users should communicate only through official SmartPayFX channels and should be cautious of anyone requesting passwords, one-time verification codes, wallet recovery phrases or other confidential credentials.
SmartPayFX cannot guarantee recovery of funds voluntarily sent by a user to a fraudster or unauthorised third party.
17. Legal & Regulatory Risk
Laws, regulations and supervisory approaches relating to digital payments, online trading, foreign exchange and digital assets may change over time.
Such changes may affect the availability, structure, limits, verification requirements or continued operation of some SmartPayFX services.
In Tanzania, virtual assets are not recognised as legal tender, and the Bank of Tanzania has identified risks associated with virtual assets including price volatility, money laundering and terrorist financing, fraud, cyber risks and regulatory arbitrage.
SmartPayFX may modify, restrict or discontinue a service where necessary to comply with applicable law, regulatory requirements or third-party service restrictions.
18. User Responsibility
Users are responsible for:
- Reviewing transaction details before confirmation.
- Ensuring all mobile money, trading account and wallet information is correct.
- Using only accounts and payment methods they are authorised to use.
- Protecting login credentials, devices and verification information.
- Understanding the risks of trading and digital currencies before participating.
- Complying with applicable laws and SmartPayFX policies.
- Contacting SmartPayFX promptly when a transaction appears incorrect or unauthorised.
19. Independence from Third-Party Platforms
SmartPayFX is an independent digital payment service provider.
Unless expressly stated otherwise, SmartPayFX is not owned by or operated by Deriv, Weltrade, HFM, Exness, mobile money providers, blockchain networks or other third-party services referenced on the platform.
SmartPayFX does not control and is not responsible for the trading performance, account decisions, platform rules, system availability, withdrawals, suspensions or other independent actions of third-party platforms.
All third-party names, brands, logos and trademarks remain the property of their respective owners.
20. Acceptance of Risk
By using SmartPayFX, you acknowledge that you have read and understood this Risk Disclosure and accept the risks associated with digital payments, trading-platform transactions, mobile money services, currency conversion and supported digital assets.
You also acknowledge that SmartPayFX cannot eliminate every operational, market, technological, regulatory or third-party risk associated with these services.
